No refunds or Exchanges. Heriz Gallery remains the owner of all goods consigned in terms hereof until payment of the net price of the goods reflected herein has been made in cash to Heriz Gallery. The prices are net and no trade-in and/or allowance will be considered. All goods taken from or delivered by Heriz Gallery, in terms of “appro”, are returnable to Heriz Gallery upon demand but in any event not later than 48 hours after time of receipt or delivery. Any goods not returned within this 48-hour period will be regarded as being purchased by the Consignee and the credit card imprint will be processed accordingly. The Consignee is responsible for all transport costs to and from Heriz Gallery, and the risk against hazard or loss in the goods passes to the Consignee immediately the said goods leave the premises of Heriz Gallery. The airways, railways or any other cartage contractor or post office, in accepting and delivering the said goods to the Consignee, or in returning same to Heriz Gallery, shall always be deemed to be agents of the Consignee. The Consignee is under duty to return the said goods to Heriz Gallery, in good order and repair. Proof of return of any goods to Heriz Gallery, shall be acknowledged by way of written acceptance thereof by Heriz Gallery and no other method. With the signature of the Consignee hereto, the Consignee acknowledges receipt of the said goods in good order and repair and agrees to abide by all the terms and conditions hereof.
It is acknowledged by the Consignee’s signature placed hereon that:
- The Consignee has personally and physically inspected/ examined the goods concerned in the presence of an employee of Heriz Gallery prior to taking delivery thereof.
- The Consignee has not observed nor detected any defect, imperfection, mark or stain on the goods and agrees that same are in “good order”.
- Should the goods be returned to Heriz Gallery in anything but the same “good order”, Heriz Gallery shall be entitled to refuse to accept the goods, and claim the full price of the goods from the Consignee as provided for in the Terms and Conditions of Sale.
- Goods returned in a damaged condition shall be regarded as having been taken by and sold to the Customer/Consignee at the value as set out on the front hereof. Whether an item is damaged shall be as determined in the sole and exclusive discretion of Heriz Gallery.
Every care is taken with all goods entrusted to us. Only the best and most advanced cleaning and repair processes are used. However, all goods are received at the customer’s risk as certain defects in material become noticeable only during the cleaning or repair process. We do not accept liability for loss or damage by fire, theft, burglary, hijacking, stretching, shrinking, non-removal of stains, fading, colour-running, fraying, disintegration, insect-damage or any other loss or damage not mentioned herein. As all goods are accepted on the basis of them being used and of second-hand value, in the unlikely event of liability, compensation shall not exceed two times the charge of cleaning and repair. All goods unclaimed after one month will be sold to defray expenses. No complaints will be considered or entertained after 48 hours of delivery of goods.
